3. Client Responsibilities

As a client, you agree to:

• Provide accurate documentation, including required compliance paperwork.

• Maintain valid insurance and certifications as mandated by law.

• Communicate promptly with your dispatcher regarding load status or delays.

• Accept or decline loads within a reasonable time frame.

4. Fees and Payment Terms

We charge fees as agreed at the start of our business relationship. Payment is due as per the mutually agreed terms. Accepted methods of payment include bank transfer, credit cards, or any other mutually agreed method.

• Late Payments: A late fee may apply to overdue payments. Failure to pay may result in service suspension or termination.

5. Service Limitations

• Load Availability: Load availability is subject to market conditions. We do not guarantee continuous load availability.

• Rate Negotiations: Rates are affected by supply, demand, and market conditions, even with our efforts to secure the best rates.

• Carrier Packet Setup: The client is responsible for providing accurate information. Any delays due to inaccurate information are the client’s responsibility.

6. Termination and Cancellation Policy

Either party may terminate the service agreement with 30 days’ written notice. Immediate termination can occur if:

• Payments are not made according to the terms.

• Non-compliance with these terms or applicable laws.

• Failure to maintain insurance or legal certifications.

Upon termination, all outstanding payments must be settled immediately.

7. Insurance and Liability

Clients must maintain valid cargo and liability insurance. Misak Transportation is not liable for loss, damage, or delays caused by carriers.

8. Confidentiality

Both parties agree to keep all business details, rates, and client information confidential, even after the agreement ends.

9. Indemnification

You agree to indemnify Misak Transportation from any claims or damages arising from:

• A breach of these terms.

• Violations of laws, regulations, or ordinances.

• Loss or damage during transportation.

10. Governing Law

These terms are governed by the laws of the state of Texas, USA, and any disputes will be resolved in the courts of Texas.

11. Amendments to Terms

Misak Transportation reserves the right to update these terms at any time. Continued use of our services after changes indicates acceptance of the updated terms.
